        Exceptio, Verbale. Cic. Exception et clause qui borne et limite ou restreind une generalité.

        Exceptio. Cic. Fin de non recevoir. Quand un defendeur allegue quelque moyen, par lequel il tend à estre absouls sans ce qu'il faille entrer au principal. Comme s'il estoit poursuyvi pour raison de quelque heritage que le demandeur maintient luy appartenir par la succession de son pere. Et au contraire le defendeur alleguast avoir possedé ledict heritage à tiltre et bonne foy par l'espace de dix ou vingt ans. Quoy faisant ledict defendeur monstre apertement qu'il ne veult entrer à celle dispute de scavoir si l'heritage est venu au demandeur par la succession de son feu pere, et s'il en mourut vray seigneur et possesseur: ains seulement se veult arrester sur la verité de la possession par luy proposee. Et alleguer telle exception, n'est autre chose que Prescrire. Combien que le commun cuide que Prescrire soit à dire gaigner une chose pour l'avoir possessee à tiltre et bonne foy par temps requis: ce qui est faulx. Car prescrire, comme dict est, n'est autre chose que alleguer en jugement telle possession. Et y a bien difference entre Devenir seigneur par vertu de la possession, et alleguer la possession en jugement. Et un homme qui a possedé une chose cent ans, et par ce moyen la gaignee, et en est devenu maistre, si ne peult il estre dict avoir prescript, s'il n'a allegué sa possession en jugement. Et ne fault point dire, J'ay prescript une telle chose, ains J'en suis devenu seigneur par le moyen de ma juste possession.

    Положим, - что человек, который - оскорблен в самых сердечных привязанностях, в лице жены, сестры, дочери, позовет оскорбителя на суд за клевету. На суде этом положение сторон страшно неравное. Чтоб защититься от обвинения в клевете, посредством так называемого exceptio veritatis, достаточно обидчику сослаться, что он позорящее обстоятельство не выдумал, и доказать, что он поверил свидетелям или что в народе ходили слухи об этом обстоятельстве.     Об - весьма удобном средстве отклонить иск о клевете написаны немцами целые книги; оно называется в технике юридической exceptio veritatis или отводом посредством доказательств истины. (Он же, Г. Лохвицкий и диффамация.)
